Terms of Service

1. Service provider

Games4Cast is operated by Tiny Loop Studios, a simplified joint stock company incorporated under French law (société par actions simplifiée), with its registered office at 9 rue du Bouloi, 75001 Paris, France (SIRET: 93398005400011).

Games4Cast is a web-based software-as-a-service providing analytics and market insights on PC games available on the Steam platform, using public Steam data and proprietary statistical and machine learning models.

Games4Cast offers several subscription plans (including Free, Starter, Pro, Business) with different features, usage limits and pricing, as described on the Games4Cast website at the time of subscription.

2. Definitions

  • "User" — any natural or legal person using Games4Cast, whether acting as a professional or as a consumer.
  • "Consumer" — any natural person acting for purposes outside their trade, business, craft or profession, within the meaning of EU and French consumer law.
  • "Professional user" — any User acting for purposes relating to their trade, business, craft or profession.

3. Scope and acceptance

Access to and use of Games4Cast are governed by these Terms of Service, together with any specific conditions applicable to each subscription plan. By creating an account, subscribing to a plan or using Games4Cast, the User acknowledges that they have read, understood and accepted these Terms.

For Consumers, these Terms do not affect any mandatory rights granted by applicable consumer protection law in the EU and in the User's country of residence. In case of conflict, such mandatory rules prevail.

4. Pre-contractual information

4.1 Characteristics of the digital service

Before any subscription, Tiny Loop provides Users with clear information on:

  • the main features of Games4Cast, including the type of analytics provided, the data sources used (public Steam data, internal models), and any significant technical limitations;
  • the functionalities of the service, including dashboards, filters, export options and any update mechanisms;
  • the compatibility of Games4Cast with commonly used hardware, operating systems and browsers, and any specific technical requirements;
  • where relevant, the impact of updates on the performance and functionalities of the service.

4.2 Price and duration

Prior to subscription, Tiny Loop informs Users about:

  • the total price of each plan, including all applicable taxes;
  • any recurring charges (monthly or annual) and the conditions for renewal and termination;
  • the minimum contract duration, where applicable.

4.3 Payment and delivery

Information is provided on:

  • the accepted means of payment (via Stripe);
  • access to the service, in principle immediately after successful payment and account activation;
  • the procedures for handling complaints and support requests.

5. Account creation and access

Users must create an account, providing accurate and up-to-date information, and keep their login credentials confidential. Account creation and authentication are provided through a third-party service (Clerk).

The User is responsible for all activities carried out through their account. The User shall immediately notify Tiny Loop of any unauthorized use or security breach.

6. Acceptable use

Users agree to use Games4Cast in compliance with applicable laws and these Terms. In particular, Users shall not:

  • attempt to access Games4Cast by any unauthorized means;
  • reverse engineer, decompile or attempt to extract the source code of Games4Cast, except as permitted by mandatory law;
  • circumvent technical protection measures or usage limits;
  • use Games4Cast to develop or train a competing service using Tiny Loop's proprietary models or datasets, unless expressly authorized in writing.

Tiny Loop may suspend or restrict access in case of breach of these Terms, security risk or suspected fraudulent use, subject to prior notice where reasonably possible.

7. Dependence on Steam data and non-affiliation

Games4Cast relies in part on public data available on the Steam platform, operated by Valve Corporation. Tiny Loop has no control over the availability, accuracy or completeness of Steam data.

Games4Cast is an independent service and is not affiliated with, endorsed by, or in any way officially connected to Valve Corporation, Steam or any of their subsidiaries or affiliates. Any references to Steam are for descriptive purposes only.

Tiny Loop may have to modify or discontinue certain features if Steam or other third-party data sources change their terms, APIs or data availability. In such case, Tiny Loop will inform Users and, where applicable, adjust the service or pricing accordingly.

8. No warranty on estimates and analytics

Games4Cast provides statistical estimates and analytics (including estimated revenues and units sold) based on public data and proprietary models. These estimates are by nature uncertain and may differ significantly from actual figures.

While Tiny Loop aims to maintain high-quality models and regularly updates them, it does not guarantee the accuracy, completeness or fitness for a particular purpose of any estimate, forecast or analysis produced by Games4Cast.

Users remain solely responsible for any decisions taken on the basis of Games4Cast outputs (including investment, publishing or marketing decisions) and should not rely on Games4Cast as their sole source of information.

9. Legal guarantees for Consumers

9.1 Legal guarantee of conformity (EU and French law)

For Consumers located in the EU, Games4Cast benefits from the legal guarantee of conformity applicable to contracts for the supply of digital content and digital services under the French Consumer Code and applicable EU rules. Under this guarantee:

  • Tiny Loop must provide a service that is in conformity with the contract, including in terms of functionality, compatibility, accessibility, continuity and security, as can be reasonably expected;
  • in case of lack of conformity not attributable to the User's environment, the Consumer is entitled to have the service brought into conformity or, where conditions are met, to a price reduction or termination of the contract;
  • the legal guarantee of conformity applies without any additional cost for the Consumer and cannot be excluded.

9.2 Guarantee against hidden defects

Independently of any commercial warranty, Consumers and professional Users may benefit from the statutory guarantee against hidden defects under the French Civil Code, where applicable.

10. Right of withdrawal for Consumers

Where EU and French consumer law grants a right of withdrawal (typically 14 days from conclusion of the contract), Tiny Loop informs Consumers of the existence or absence of such right, the conditions, time limit and procedures for exercising it, and the model withdrawal form where applicable.

For digital services supplied immediately after the Consumer's express consent and acknowledgment of loss of withdrawal right, the Consumer may lose their right of withdrawal under applicable law. This will be clearly indicated at the time of subscription.

11. Support, complaints and mediation

Users may contact Tiny Loop for support or complaints at legal@tinyloopstudios.com. Tiny Loop will make reasonable efforts to respond within a reasonable time.

Consumers established in the EU may resort, in case of dispute, to a consumer mediation mechanism in accordance with the French Consumer Code. The mediator designated by Tiny Loop is: [to be designated — contact us for details]. Consumers may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.

12. Intellectual property

All intellectual property rights in Games4Cast — including its software, architecture, databases, models, algorithms, user interface, trademarks, logos and content (excluding User-generated content and third-party content such as Steam data) — are and remain the exclusive property of Tiny Loop or its licensors.

Subject to full payment of applicable fees, Tiny Loop grants the User a personal, non-exclusive, non-transferable and non-sublicensable right to access and use Games4Cast for the duration of their subscription and solely for their internal business or personal purposes, in accordance with these Terms.

Users may not reproduce, distribute, publicly display, adapt or create derivative works from Games4Cast or its content, except as expressly permitted by these Terms or by mandatory law.

13. User content and data

Users may upload or input certain content or data into Games4Cast (for example, project information, internal benchmarks). Users remain the owners of such content and grant Tiny Loop a non-exclusive license to use it solely for the purposes of providing and improving the service, and for the duration of the contract.

Users must ensure that their content does not infringe third-party rights or applicable laws. Tiny Loop may remove or disable access to content that appears unlawful or infringing.

14. Data export and account deletion

During the term of the subscription, Users may export certain data or reports from Games4Cast in the formats made available (for example, CSV, PDF), within the technical limits of their plan.

Upon termination of the subscription, Tiny Loop will close the User's access to paid features. Tiny Loop may retain certain data for a limited period for backup, accounting or legal purposes, in accordance with the Privacy Policy.

Users may request deletion of their account and personal data, subject to legal retention obligations, by contacting Tiny Loop as described in the Privacy Policy.

15. Limitation of liability

To the maximum extent permitted by applicable law, Tiny Loop shall not be liable for:

  • indirect, consequential or non-material damages such as loss of profit, loss of opportunity, loss of data or business interruption;
  • decisions or investments made by Users based solely on Games4Cast outputs;
  • unavailability or degradation of the service due to third-party providers, networks or data sources (including Steam), force majeure or events beyond Tiny Loop's reasonable control.

For professional Users, Tiny Loop's aggregate liability for any damages arising out of or in connection with the service shall be limited to the total amount paid by the User to Tiny Loop for the subscription during the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms shall exclude or limit liability that cannot be excluded or limited under applicable law (such as liability for death or personal injury caused by negligence, or for gross negligence or wilful misconduct).

16. Duration, renewal and termination

Subscriptions are concluded for the initial term indicated at the time of order (for example, monthly or annual) and may be tacitly renewed, unless cancelled by the User in accordance with the cancellation process described on the website or in their account.

Users may terminate their subscription at any time, with effect at the end of the current billing period, unless otherwise specified for a given plan.

Tiny Loop may terminate the contract or suspend access, with reasonable notice, in case of serious or repeated breach of these Terms by the User, or if required by law or by a competent authority.

17. Personal data and privacy

Tiny Loop processes personal data in connection with Games4Cast in accordance with its Privacy Policy, which forms an integral part of these Terms.

18. Governing law and jurisdiction

These Terms are governed by French law, without prejudice to the mandatory consumer protection rules of the User's country of residence within the EU.

In case of dispute and failing amicable resolution or mediation, the competent courts of Paris, France, shall have jurisdiction, subject to any mandatory jurisdiction rules applicable to Consumers.
